1. Introduction

These Terms and Conditions of Trade (“Terms”) govern the business relationship between Hvac Solutions SEQ (“Hvac Solutions SEQ,” “we,” “our,” or “us”) and our clients (“you” or “your”), regarding the provision of air-conditioning and climate control products, services, and related solutions (“Services”). By engaging with or accepting our Services, you agree to be bound by these terms and the terms included on our quotes.

 

2. Quoting, pricing, orders, and acceptance

2.1 Hvac Solutions SEQ reserves the right to adjust prices due to unforeseen circumstances and supplier price increases. Works will be re-quoted accordingly even after quote acceptance.

2.2 Hvac Solutions SEQ can withdraw the quote at any time at our discretion.

2.3 Quotations provided by Hvac Solutions SEQ are valid for a period specified therein or 30 days, whichever is shorter.

2.4 To initiate an order, the client must provide written acceptance of Hvac Solutions SEQ quotation or proposal.

2.5 Acceptance constitutes acknowledgment and agreement to these Terms.

 

3. Electrical works

3.1 Supply and interconnect by our registered contracting electrician.

3.2 Power supply from the existing board.

3.3 Power supply from existing power circuit.

 

4. Exclusions

4.1 Electrical mains upgrade if required.

4.2 Patching or painting.

 

5. Warranties

 5.1 Hvac Solutions SEQ warrants the workmanship of the installation for twelve (12) months, if any issues arise in this time, contact our team.

5.2 Warranty may be voided if equipment is tampered with, improperly maintained, or used in violation of manufacturer instructions.

 

6. Terms of Payment

6.1 On completion.

6.2 50% deposit at time of quote acceptance and 50% at completion.

6.3 Non-refundable deposit at Hvac Solutions SEQ discretion.

6.4 5 days cooling off period.

6.5 $100 fee will incur if cancellation during cooling off period.

6.6 1.1% surcharge of eftpos.

6.7 In the event where your overdue account is referred to a debt collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs.

 

7.  Services

7.1 Hvac Solutions SEQ will provide air-conditioning and climate control products, installation, maintenance, repair, and related services as mutually agreed upon with the client.

7.2 The scope of work, including specifications, costs, and timelines, will be detailed in a separate written agreement or proposal.

 

8. Delivery and Installation

8.1 Delivery and installation timelines will be agreed upon with the client.

8.2 Delays caused by unforeseen circumstances, including weather, supplier issues, or regulatory approvals, are not the responsibility of Hvac Solutions SEQ.

8.3 The client shall provide suitable access and conditions for installation.

8.4 Hvac Solutions SEQ are not responsible for installation designs from a third party. Hvac Solutions SEQ only warrant our own installation designs.

 

9. Limitation of Liability

9.1 Hvac Solutions SEQ shall not be liable for indirect, incidental, consequential, or special damages arising from the provision of Services or use of our products, this includes Subcontract work.

9.2 The liability of Hvac Solutions SEQ for any claim, including breach of contract or warranty, shall be limited to the amount paid for the specific Services.

9.2 Upon payment of invoice for services and goods supplied by HVAC Solutions SEQ in accordance to the quote and invoice, the client deems the works completed are satisfactory.
